Unity of Invention Under The European Patent Convention - Interactions Between Search and Examination Phases

Interactions Between Search and Examination Phases

The responsibility for establishing whether or not a European patent application meets the requirements of unity of invention ultimately rests with the examining division. Therefore, the findings of the search division —that the application lacks unity— may be contested before the examining division, during the examination phase. If successful and if further search fees had been paid during the search phase, the further search fees may be refunded. If successful and if further search fees had not been paid during the search phase, "the applicant is entitled as of right to have the whole subject-matter of his unitary invention searched".

Famous quotes containing the words interactions between, interactions, search, examination and/or phases:

The exercise of power is determined by thousands of interactions between the world of the powerful and that of the powerless, all the more so because these worlds are never divided by a sharp line: everyone has a small part of himself in both.
    Václav Havel (b. 1936)

    why
Do our black faces search the empty sky?
Is there something we have forgotten? some precious thing
We have lost, wandering in strange lands?
    Arna Bontemps (1902–1973)

Whilst Marx turned the Hegelian dialectic outwards, making it an instrument with which he could interpret the facts of history and so arrive at an objective science which insists on the translation of theory into action, Kierkegaard, on the other hand, turned the same instruments inwards, for the examination of his own soul or psychology, arriving at a subjective philosophy which involved him in the deepest pessimism and despair of action.
    Sir Herbert Read (1893–1968)

This socialism will develop in all its phases until it reaches its own extremes and absurdities. Then once again a cry of denial will break from the titanic chest of the revolutionary minority and again a mortal struggle will begin, in which socialism will play the role of contemporary conservatism and will be overwhelmed in the subsequent revolution, as yet unknown to us.
    Alexander Herzen (1812–1870)
