As of October 2011, there are two vacancies on the court. One vacancy was created by the decision of Judge Frank R. Zapata, effective August 3, 2010, to assume senior status. On June 23, 2011, President Obama nominated Rosemary Márquez to that vacancy. Another vacancy was created by the elevation of Judge Mary Murguia to the Ninth Circuit Court of Appeals.
