MOSAIC Threat Assessment Systems - Admissibility of MOSAIC in Court

Admissibility of MOSAIC in Court

The developer's website notes that "MOSAIC is not designed or intended to be used as evidence in court proceedings." The Frey standard for admissibility of scientific evidence, currently in use in approximately 14 states (the number changes as new cases are decided by appellate courts) requires that scientific evidence must have gained "general acceptance" in the field to which it belongs. The Daubert standard, currently in use in approximately 30 states and US Federal courts, requires among other things that new scientific methods must have been peer reviewed. Given the absence of peer reviewed articles and the absence of any indication that the MOSAIC system has been generally accepted within the forensic evaluation community, it is likely that in addition to being "not designed or intended" to be used in court proceedings, information derived from use of the system would be inadmissible as well.

Famous quotes containing the word court:

Rome, like Washington, is small enough, quiet enough, for strong personal intimacies; Rome, like Washington, has its democratic court and its entourage of diplomatic circle; Rome, like Washington, gives you plenty of time and plenty of sunlight. In New York we have annihilated both.
    M. E. W. Sherwood (1826–1903)
