Race Trac has waged legal fights to allow it to sell gasoline below cost. Critics argue that the practice is done temporarily to drive smaller competitors out of business.

In one Daytona Beach case, RaceTrac defended the practice on the grounds that the number of competitors they drove out of business with the practice was not large enough to meet the criteria of the law.
