Whether It Is A Statutory Offence
In DPP v. Taylor, DPP v. Little 1 QB 645, 95 Cr App R 28, it was held that common assault is a statutory offence, contrary to section 39 of the Criminal Justice Act 1988. This decision was criticised and in Haystead v DPP 164 JP 396, DC, the Divisional court expressed the obiter opinion that common assault remains a common law offence.

Famous quotes containing the words whether it and/or offence:
“Italians, and perhaps Frenchmen, consider first whether they like or want to do a thing and then whether, on the whole, it will do them any harm. Englishmen, and perhaps Germans, consider first whether they ought to like a thing and often never reach the questions whether they do like it and whether it will hurt. There is much to be said for both systems, but I suppose it is best to combine them as far as possible.”
—Samuel Butler (18351902)
“It breedeth no small offence and scandal to see and consider upon the one part the curiosity and cost bestowed by all sorts of men upon their private houses; and on the other part the unclean and negligent order and spare keeping of the houses of prayer by permitting open decays and ruins of coverings of walls and windows, and by appointing unmeet and unseemly tables with foul cloths for the communion of the sacrament.”
—Elizabeth I (15331603)
