Security Act Regarding North Korea
South Korea's security act towards North Korea is quite contradictory. This national act is a law that symbolizes the history of Korea division. This security act has gone through several changes that reflects the environment two Korea have gone through. Due to the collapse of the communist bloc in Eastern Europe and the fragmentation of the Soviet Union, the international society was reforming the post-Cold war world order. The security act towards North Korea has also gone through some changes after the Cold-war. The inter-Korean summit in 2000 showed the process of reshaping relationship between two Koreas. it was regarded as a step to bring peace to the Korean Peninsula through reconciliation and cooperation. This expectations was quite convincing during Kim dae jung and Roh moo hyun administration, with the enactment of the Sunshine policy and The peace and prosperity policy. However, the South Korea's national security act states North Korea as an anti-state group. This act regulates anti-state activities that may hurt or threaten South Korea's national security. On the other hand, there is the inter Korean Exchange and Cooperation Act that sees North Korea as a fundamental partner of South Korea. These two Act are ultimately contradicting to each other, calling for revision as there are confusions being made when dealing North Korea. This contradicting Act are likely to produce chaos within South Korea government when it comes down to making important diplomatic and political decisions regarding North Korea.
Regarding these problems stated above, North Korea's security act is supported by the covenant of the Labor Party, the penal code of the North, and the constitution. They sees South Korea as a group that needs to be revolutionized and freed. This idea of North Korea's Security Act itself is what prevents two Koreas from making the unification-oriented legislation, excelerating hostiltiy between two sides.
