Opinion of The Court
The Court affirmed the decision of the Eleventh Circuit in a 5-4 ruling. Justice Ruth Bader Ginsburg delivered the opinion for the majority, holding that district courts are permitted, but not obliged, to consider, sua sponte, the timeliness of a state prisoner's habeas corpus petition. Based on precedent involving other affirmative defenses to habeas petitions, and the perceived lack of difference between outright dismissal by the district court and dismissal after allowing the State to amend its answer to include the limitations defense, the Court did not consider the district court's dismissal of Day's petition to be an abuse of discretion. Justices John Paul Stevens and Antonin Scalia filed dissenting opinions.

Famous quotes containing the words opinion of, opinion and/or court:
“As to conforming outwardly, and living your own life inwardly, I have not a very high opinion of that course.”
—Henry David Thoreau (18171862)
“In spite of all the learned have said,
I still my old opinion keep;
The posture, that we give the dead,
Points out the souls eternal sleep.
Not so the ancients of these lands
The Indian, when from life released,
Again is seated with his friends,
And shares again the joyous feast.”
—Philip Freneau (17521832)
“We went on, feeding the hungry, giving drink to the thirsty, clothing the soldier, binding up his wounds, harboring the stranger, visiting the sick, ministering to the prisoner, and burying the dead, until that blessed day at Appomattox Court House relieved the strain.”
—M. E. W. Sherwood (18261903)
