Criticism

Some critics of the dual CTM/national system have expressed doubts particularly with regard to confusion which they consider arises from maintaining two separate trademark registration systems. This is similar to criticism which been directed at the parallel existence of the Madrid Agreement and the Madrid Protocol.

However, others see the dual system as providing an effective solution to EU harmonisation issues which has continued to work well over a period of many years.
