Hypothec (/hʌɪˈpɒθɪk/ or /ˈhʌɪpɒθɪk/; from Lat. hypotheca, Gr. ὐποθήκη: hypothéke) is a mortgage in Roman and Scots law, in other words, a legal right over a debtor's property that however remains in the debtor's possession.
