False arrest is a common law tort, where a plaintiff alleges he or she was held in custody without probable cause, or without an order issued by a court of competent jurisdiction. Although it is possible to sue law enforcement officials for false arrest, the usual defendants in such cases are private security firms.

Famous quotes containing the words false and/or arrest:
“Rhyme, the rack of finest wits,
That expresseth but by fits
True conceit,
Spoiling senses of their treasure,
Cozening judgment with a measure,
But false weight;
Wresting words from their true calling;
Propping verse for fear of falling
To the ground;
Jointing syllables, drowning letters,
Fastening vowels, as with fetters
They were bound!”
—Ben Jonson (15721637)
“An unjust law is itself a species of violence. Arrest for its breach is more so.”
—Mohandas K. Gandhi (18691948)
