In 2004 a letter by a member of the public was submitted to the Competition Commission which started an investigation into anti-competitive behavior in the dairy industry. The subsequent investigation found evidence of price fixing for raw and retail milk and that trading conditions were manipulated in these markets. Clover along with 6 other dairy processors was implicated. The case against Clover was withdrawn in April 2011 due to the fact that the supreme court ruled that the Competition Commission’s initiation of the investigation into anticompetitive conduct in the milk industry was unlawful because it did not specific allegations faced by each firm and was not based on a reasonable suspicion that all firms in the industry were engaged in such conduct.
