Supreme Court of Canada Ruling
Four issues were presented to the Supreme Court to decide:
On the appeal:
- Would a licence from a freelance author specifically granting a publisher the right to republish his or her article in the electronic databases need to be in writing?
- Does Robertson have standing to assert a claim on behalf of employees of the Globe?
On the cross-appeal:
Whether the electronic databases infringed the right of
- freelance authors; and
- Globe staff writers.
The bulk of the opinion was focused on the first of the cross-appeal issues.

Famous quotes containing the words supreme, court, canada and/or ruling:
“Few and signally blessed are those whom Jupiter has destined to be cabbage-planters. For theyve always one foot on the ground and the other not far from it. Anyone is welcome to argue about felicity and supreme happiness. But the man who plants cabbages I now positively declare to be the happiest of mortals.”
—François Rabelais (c. 14941553)
“To take revenge halfheartedly is to court disaster: Either condemn or crown your hatred.”
—Pierre Corneille (16061684)
“This universal exhibition in Canada of the tools and sinews of war reminded me of the keeper of a menagerie showing his animals claws. It was the English leopard showing his claws.”
—Henry David Thoreau (18171862)
“A theory of the middle class: that it is not to be determined by its financial situation but rather by its relation to government. That is, one could shade down from an actual ruling or governing class to a class hopelessly out of relation to government, thinking of govt as beyond its control, of itself as wholly controlled by govt. Somewhere in between and in gradations is the group that has the sense that govt exists for it, and shapes its consciousness accordingly.”
—Lionel Trilling (19051975)
