While Schwellenbach reportedly wished to be appointed to the Supreme Court, Roosevelt instead appointed him to a federal district court (for the Eastern District of Washington) in 1940. In 1943, he inadvertently stumbled onto the then-extremely secret Manhattan project — the development of the atomic bomb — in connection with a large land condemnation deal for a DuPont processing plant.
