Consumer Protection Act 1987 - Consumer Safety

Consumer Safety

Section 10 originally imposed a general safety requirement on consumer products but this was repealed when its effect was superseded by the broader requirements of the General Product Safety Regulations 2005.

Section 11 gives the Secretary of State, as of 2008 the Secretary of State for Business, Enterprise and Regulatory Reform, the power to make, after consultation, regulations by way of Statutory Instrument to ensure that:

  • Goods are safe;
  • Unsafe goods, or goods which would be unsafe in the hands of certain persons, are not made available to persons generally;
  • That appropriate, and only appropriate, information is provided in relation to goods.

Regulations under this section cannot be made to apply to (s.11(7)):

  • Growing crops and other things which are part of land because they are attached to it;
  • Water, food and fertiliser;
  • Gas supplied under the Gas Act 1986 or the Gas (Northern Ireland) Order 1996;
  • Controlled drugs and licensed medicinal products.

Famous quotes containing the words consumer and/or safety:

    Vice is its own reward. It is virtue which, if it is to be marketed with consumer appeal, must carry Green Shield stamps.
    Quentin Crisp (b. 1908)

    A lover is never a completely self-reliant person viewing the world through his own eyes, but a hostage to a certain delusion. He becomes a perjurer, all his thoughts and emotions being directed with reference, not to an accurate and just appraisal of the real world but rather to the safety and exaltation of his loved one, and the madness with which he pursues her, transmogrifying his attention, blinds him like a victim.
    Alexander Theroux (b. 1940)
