In all Australian states and territories, cohabiting same-sex couples are recognised as de facto couples, and have the same rights as cohabiting heterosexual couples under state law. From 1 March 2009 a new section in the Family Law Act 1975 has limited jurisdiction over de facto relationships that have a geographical connection, see sections 90RG,90SD and 90SK with a participating state, section 90RA, of the Family Law Act.
