Supreme Court of Canada Judgment

The Court stated that the Act was ultra vires the province and should be struck down. In performing pith and substance analysis on the legislation by looking at the Act's purpose and effect, the Court found that the Act was Colourable. Famous quotes containing the words supreme, court, canada and/or judgment:

The woman and the genius do not work. Up to now, woman has been mankind’s supreme luxury. In all those moments when we do our best, we do not work. Work is merely a means to these moments.
    Friedrich Nietzsche (1844–1900)

Rome, like Washington, is small enough, quiet enough, for strong personal intimacies; Rome, like Washington, has its democratic court and its entourage of diplomatic circle; Rome, like Washington, gives you plenty of time and plenty of sunlight. In New York we have annihilated both.
    M. E. W. Sherwood (1826–1903)

What makes the United States government, on the whole, more tolerable—I mean for us lucky white men—is the fact that there is so much less of government with us.... But in Canada you are reminded of the government every day. It parades itself before you. It is not content to be the servant, but will be the master; and every day it goes out to the Plains of Abraham or to the Champs de Mars and exhibits itself and toots.
    Henry David Thoreau (1817–1862)

Life is short, the art long, opportunity fleeting, experiment treacherous, judgment difficult.
    Hippocrates (c. 460–370 B.C.)
