Tribal Sovereignty
The issue of Native American sovereignty has been debated for over 200 years. Chief Justice John Marshall stated that Native American tribes are “domestic dependent nations under the umbrella of U.S. government protection.” The IGRA’s goals – strong tribal government, self-sufficiency, and economic development—greatly affect sovereignty issues today. Tribes, state governments, the federal government, and businesses disagree about who should be given regulatory power over the thriving Indian gaming industry.
